Terms of Service
Effective date: June 28, 2026. We'll email you before making any material changes.
Who this is for
Kaiwa is for people who are 13 or older (16 or older if you're in the EU). By creating an account, you confirm you meet this requirement.
One account per person. Sharing account credentials is not allowed.
Subscriptions and billing
Kaiwa offers a free tier and a Pro subscription ($19/month or $180/year). Billing is handled by Stripe and renews automatically at the end of each billing period.
You can cancel anytime from Settings → Billing. When you cancel, your access continues until the end of the period you already paid for.
Refunds: All subscription fees are non-refundable except where required by applicable law. If we charged you incorrectly, email us at support@kaiwaflow.com within 14 days of the charge.
EU users: Under EU consumer law, you have a 14-day right to cancel a digital service purchase. However, if you request immediate access to the service when you subscribe and acknowledge that this waives your cooling-off right, that right no longer applies. We'll ask you to confirm this at checkout.
Price changes: We'll give you at least 30 days notice before raising subscription prices.
Beta service
Kaiwa is currently in beta. Features may change, be temporarily unavailable, or be discontinued. We'll give you a heads-up before anything major changes.
This doesn't mean we can disappear on you if you're paying. If we shut down the service entirely, Pro subscribers will receive a prorated refund for unused time.
This disclaimer does not limit your rights as a consumer under applicable law.
Your content
Your uploaded vocabulary lists, conversation history, and other content you create in Kaiwa are yours. We don't claim ownership of them.
You give us permission to process your content to run the service, nothing else. We don't use your content to build products for third parties, train AI models, or anything outside of running Kaiwa for you.
By uploading vocabulary content (like Anki decks), you're confirming you have the right to share it with us. Some deck content may be licensed from third parties; that's between you and the deck creator.
AI processing
Kaiwa uses third-party AI technology (Anthropic Claude API, via OpenRouter) to generate conversation responses. Keep in mind:
- AI-generated content can be inaccurate, biased, or just wrong. Don't rely on it for medical, legal, financial, or safety decisions.
- Sensei is a language practice tool, not a licensed tutor or therapist.
- Your conversation text is sent to Anthropic's API to generate responses. Anthropic doesn't retain your conversations for model training (per their API policy).
Acceptable use
Don't use Kaiwa to:
- Scrape or automate requests to our API
- Circumvent usage limits
- Generate harmful, illegal, or abusive content
- Reverse-engineer or resell access to the service
We'll suspend or terminate accounts that violate these rules.
Liability
To the maximum extent permitted by applicable law, Kaiwaflow's total liability to you for any claim related to the service is capped at the greater of: (a) the fees you paid in the 12 months before the claim, or (b) $100.
We're not liable for indirect, incidental, or consequential damages.
EU and UK users: Some of the above limitations may not apply to you under local consumer protection law.
Governing law
These terms are governed by the laws of California, United States. Disputes should be raised by email first; we'd rather fix it directly than involve lawyers.
EU and UK users: You may also bring claims in the courts of your country of residence. Any arbitration clause in these terms does not apply to you.
